Terms and Conditions

This English version is provided for convenience only. In the event of any discrepancy between the Korean and English versions, the Korean version shall prevail.

<Chapter 1 General Provisions>

Article 1 Purpose
1. These Terms and Conditions govern the terms, conditions, and procedures for using the web services operated by the Seoul Drama Awards Organizing Committee (Incorporated Association) (hereinafter referred to as the “Organizing Committee”).
2. Please complete membership registration only after fully reviewing and understanding the terms governing membership registration. These Terms and Conditions apply to all members who use any web service operated by the Organizing Committee, and each member is responsible for reading and understanding them.

Article 2 Notice and Effect of the Terms and Conditions
1. These Terms and Conditions shall become effective when posted on the web service screen or otherwise notified to members.
2. The Organizing Committee may amend these Terms and Conditions, and the amended Terms and Conditions shall become effective upon notice in the same manner as set forth in Paragraph 1.
3. Membership registration means registering for the web services provided by the Organizing Committee and constitutes agreement to the terms and rules governing the web services. The Organizing Committee reserves the right to change all or part of the terms and provisions of the web services at any time, with or without notice. Members may not object on the grounds that they were unable to respond promptly to such changes or did not receive notice thereof.

Article 3 Matters Not Provided for in These Terms and Conditions
Matters not provided for in these Terms and Conditions shall be governed by the Framework Act on Telecommunications, the Telecommunications Business Act, the Framework Act on Electronic Documents and Transactions, the Digital Signature Act, the Act on Door-to-Door Sales, and other related statutes.

Article 4 Definitions
The definitions of the terms used in these Terms and Conditions are as follows:
1. Member: A person who has entered into an agreement with the Organizing Committee to use the web services.
2. ID: A combination of letters and numbers selected by the member and approved by the Organizing Committee for the purpose of identifying the member and enabling the member’s use of the services.
3. Password: A combination of letters and numbers selected by the member in order to protect the member’s confidentiality in communications.
4. Withdrawal: A member’s expression of intent to terminate the use contract after having used the services.

<Chapter 2 Service Use Agreement>

Article 5 Formation of the Service Use Agreement
1. When applying for service membership, clicking the “Agree” button after reading these Terms and Conditions shall be deemed consent to these Terms and Conditions.
2. The service use agreement is formed when the applicant selects “Complete” after entering the required member information.
3. Any person who wishes to register as a member and use the services must provide the personal information requested by the Organizing Committee.
4. As a rule, the use contract shall be concluded with one ID per member.

Article 6 Application to Use the Service
An application to use the service shall be submitted using the online membership application form.

Article 7 Acceptance of Application
The application shall be accepted when the member accurately enters all matters required under Chapter 2, Article 2 hereof and submits the application for use.

Article 8 Rejection of Application
1. The web service may reject registration, or may modify or delete member information without notice even after registration, if an application for use falls under any of the following:
1) Where the application is made using another person’s name;
2) Where the application is made by entering required information falsely;
3) Where the application is made for the purpose of harming public order and good morals;
4) Where the applicant is registered as a person of poor credit standing pursuant to the Act on the Use and Protection of Credit Information;
5) Where acceptance of the application is otherwise difficult for reasons attributable to the applicant.
2. The Organizing Committee may defer acceptance of an application for use falling under any of the following until the relevant cause is resolved:
1) Where the Organizing Committee has insufficient facility capacity;
2) Where there is a technical impediment on the part of the Organizing Committee;
3) Where the Organizing Committee otherwise deems it necessary.
3. Where an application for use is not accepted or acceptance is restricted, the Organizing Committee shall notify the applicant thereof.

Article 9 Change of Registration Information
If any information entered at the time of application changes, the member must update such information online.

Article 10 Sharing of Member Information
1. Where the Organizing Committee enters into a partnership, acquisition, spin-off, or merger with another institution for the purpose of providing improved services, member information may be shared.
2. In the case of events in which various prizes are offered, the registration information of winners may be shared upon consultation with the prize sponsor.
3. Where a cause under Paragraph 1 or 2 arises, the Organizing Committee shall notify the member of the relevant fact.

Article 11 Use of Supplementary Member Information
The Organizing Committee shall use additional member information provided by a member when using community services solely for administrative and statistical purposes.

Article 12 Provision of Information
The Organizing Committee may provide members with information regarding service use, events hosted or operated by the Organizing Committee, and other information services by electronic mail, postal mail, or similar means.

Article 13 Protection of Personal Information
1. When collecting a user’s personal information, the Organizing Committee shall obtain the consent of the relevant user.
2. The Organizing Committee shall be fully liable for any damage suffered by a user if personal information is used for any purpose other than internal administration, statistical use, or the purposes set forth in Chapter 2, Article 6, or if such information is provided to a third party without the user’s consent, or is lost, stolen, leaked, or altered.

<Chapter 3 Use of the Services>

Article 14 Availability of the Services
In principle, the services are available 24 hours a day, year-round, unless there is a special operational or technical impediment on the part of the Organizing Committee. However, where the Organizing Committee deems it necessary for service improvement, such as regular maintenance, the services may be temporarily suspended upon prior notice.

Article 15 Suspension of Service Provision
The Organizing Committee may suspend the provision of the services in any of the following cases:
1. Where suspension is unavoidable for reasons such as facility maintenance;
2. Where a key telecommunications business operator prescribed in the Telecommunications Business Act suspends telecommunications services;
3. Where any other cause arises that prevents the Organizing Committee from providing the services.

Article 16 Deletion of File Information and Revocation of Member Privileges
1. Where the Organizing Committee determines that there is insufficient capacity in the service facilities, it may delete a member’s information and personal information as necessary.
2. The Organizing Committee may inspect, without prior notice, the information and personal information of a member deemed to raise concerns regarding service operation or security.
3. In the case of Paragraph 1, the Organizing Committee shall give prior notice of the relevant action through the service or by electronic mail.

<Chapter 4 Restriction on Service Use and Termination of Agreement>

Article 17 Restriction on Service Use
1. In using the services, a member shall ensure that none of the following applies, and where any of the following applies, use of the services may be restricted:
1) The act of fraudulently using another member’s ID;
2) An act for the purpose of a criminal offense or otherwise related to a criminal offense;
3) An act that harms good morals or other social order;
4) An act that defames or insults any other person;
5) An act that infringes the intellectual property rights or other rights of another person;
6) The act of hacking or of distributing computer viruses;
7) The act of continuously transmitting certain content, such as advertising information, against another person’s will;
8) Any act that interferes with, or is likely to interfere with, the stable operation of the services;
9) Any other act that violates applicable statutes.

Article 18 Termination of Agreement
1. Where a member wishes to terminate the service use agreement, the member must apply to the Organizing Committee in person through the service or by electronic mail at least one day prior to the desired termination date (provided that, where the termination date falls on a statutory public holiday, at least two days before the commencement of the holiday).
2. Where a member violates the contents of Chapter 4, Article 1 and does not remedy the violation within the period prescribed by the Organizing Committee, the Organizing Committee may terminate the service use agreement.
3. Where a member whose agreement has been terminated pursuant to Paragraph 2 applies to use the service again, the Organizing Committee may restrict acceptance thereof for a certain period.

<Chapter 5 Responsibilities>

Article 19 Obligations of the Member
1. The member is solely responsible for managing the member’s ID and password.
2. The member’s ID and password may not be assigned, leased, or lent to another person without the prior consent of the Organizing Committee.
3. Where the member’s ID is used fraudulently, the member must notify the Organizing Committee of that fact without delay.
4. Where there is any change in the matters entered in the application for use, the member shall notify the Organizing Committee of such content through the service.
5. The member shall comply with the matters prescribed in these Terms and Conditions and in related statutes.

Article 20 Obligations of the Organizing Committee
1. Except in the cases set forth in Chapter 3, Articles 1 and 2, the Organizing Committee shall enable the member to use the service on the service commencement date applied for by the member, in accordance with these Terms and Conditions.
2. The Organizing Committee shall provide the services continuously and stably in accordance with these Terms and Conditions. However, even where a loss of a member’s personal information occurs due to unavoidable circumstances, the Organizing Committee shall not be liable.
3. The Organizing Committee shall not disclose or distribute a member’s personal information to another person without the member’s consent. However, this shall not apply where there is a request from a state agency or the like pursuant to related statutes such as telecommunications-related laws.
4. Where an opinion or complaint submitted by a member is deemed justified, the Organizing Committee shall process it immediately. However, where immediate processing is difficult, the Organizing Committee shall notify the member of the reason and the processing schedule.

Article 21 Deletion of Postings or Content
The Organizing Committee may delete, without prior notice or consent, any posting or content on the service that violates Chapter 4, Article 1 or exceeds the posting period prescribed by the Organizing Committee.

<Chapter 6 Damages and Disclaimer>

Article 22 Liability for Damages
The Organizing Committee shall not be liable for any damage incurred by a member in connection with the use of the services, except where such damage is caused by the Organizing Committee’s gross negligence.

Article 23 Disclaimer
1. The Organizing Committee shall be exempt from liability for service provision where it is unable to provide the services due to a natural disaster or other force majeure event.
2. The Organizing Committee shall not be liable for any interruption or impairment in service use caused by reasons attributable to the member.
3. The Organizing Committee shall not be liable for any expected profit or loss arising from a member’s use of the services, or for any damage arising from data obtained through the services.
4. The Organizing Committee shall not be liable for the reliability, accuracy, or content of information, data, or facts posted by a member on the services.
5. The member shall be responsible for all damage arising from negligence in managing or using the member’s ID and password, fraudulent use by a third party, or similar causes.
6. Where, as a result of a member violating Chapter 4, Article 1 or other provisions of these Terms and Conditions, the Organizing Committee incurs liability to a member or third party and suffers damage as a result, the member who violated these Terms and Conditions shall compensate the Organizing Committee for all damage arising therefrom and shall indemnify and hold the Organizing Committee harmless from such damage.

<Chapter 7 Miscellaneous>
Article 24 Amendment of the Terms and Conditions
When these Terms of Service are amended, notice shall be given at least seven (7) days in advance; where the amendment is disadvantageous to consumers, notice shall be given at least thirty (30) days in advance.

Article 25 Resolution of Disputes
1. The Organizing Committee and the member shall make all necessary efforts to amicably resolve any dispute arising in connection with the services.
2. Notwithstanding the provision of Paragraph 1, where a lawsuit is filed due to such a dispute, the court having jurisdiction under the Civil Procedure Act shall have exclusive jurisdiction.

Addendum
Effective Date: The amended provisions shall take effect as of February 1, 2021.
